Harrisonburg City Council upholds regulation of vape shops near schools, daycare centers

HARRISONBURG, Va. (ROCKTOWN NOW) – Harrisonburg City Council voted unanimously to further regulate the location of tobacco, smoke and vape shops in the friendly city.

Public Works Director Tom Hartman explained the ordinance during Tuesday night’s meeting.

“The most important component here is that we would be proposing to prohibit tobacco smoke or vape shops on property within 1,000 feet of any property containing a public or private school or child daycare center,” Hartman said.

The 1,000-foot distance is the maximum allowed by state law.

Council discussed that same proposal for skill games, which drew question from some business owners in Harrisonburg who offer those games alongside their other services. Donna Finnegan, who owns downtown Harrisonburg bar ‘Finnegan’s Cove,’ felt that the proposal would unfairly punish adults who responsibly play those skill games.

“I do understand middle school, high school…maybe elementary, but daycare?” Finnegan asked. “They’re 5 and under. They’re not toddling in to play a skill game or toddling in to a vape shop, it doesn’t make any sense.

The Council voted to table the proposal for skill games until the Fall, when they can gauge their use in the city – particularly among students. Council member Chris Jones made the motion.

“The best time to get the information will be when the college students come back,” Jones said. “Because, really, we operate between August and May, so if we can get an idea of what happens in August and September, that will give us different data.”

In the meantime, skill games are still illegal in Virginia.
